Who is at Fault in a Left-Hand Accident?

Vehicle accidents often result in property damage, as well as acute injuries to car passengers which cause unwelcome pain and suffering. If you’ve been involved in an accident as the result of a left turn accident, the first question asked, after the injuries are treated, is who is at fault for the collision.

Vehicle use continues to rise, as highways become more jammed, and speed along with a failure to yield the right of way or know the rules of the road also come into play.

Fault in a Left Turn Accident

In most cases, the vehicle making the left-hand turn when an accident occurs is found at fault and responsible for the collision. Why? Most traffic laws across the country state a vehicle making a left turn wait until making the turn is completely safe. This means yielding before entering and moving through oncoming traffic (oncoming traffic has the right of way).

Failure to yield to approaching oncoming traffic and driver carelessness are often the cause of left hand turn crashes. Even so, there are exceptions to this generally accepted rule of liability in a left turn accident. Exceptions include circumstances when the oncoming vehicle’s driver was:

  • Driving in excess of the speed limit
  • Under the influence of alcohol or drugs
  • Ran a red light
  • Distracted (texting or using the cellphone) resulting in the accident

Another exception includes incidences when a malfunction or unexpected event causes the vehicle to slow or stop while making the left turn.

Injuries Common in a Left-hand Turn Accident

If you are involved in a left-hand turn collision, the first course of action is to call the police and ensure that anyone injured gets medical attention. The police arriving at the scene will take down your testimony of how the accident occurred, adding his or her own observations of the accident. Some injuries may not manifest until days later and should be checked out immediately to avoid permanent damage and lifelong pain resulting from the accident.

Injuries common in left turn accidents include:

As a result of these injuries, you may also experience weakness, pain, and other discomfort. Your doctor and his or her medical team will evaluate your injuries and order tests to determine the scope of the damage. Tests like X-rays and MRIs can help the doctor with your diagnosis. After diagnosis, your medical team will develop a customized care plan to relieve your pain and help you achieve a full recovery. Your treatment will include chiropractic treatment to return your body to complete strength and flexibility.
