Who’s at Fault in a Side Impact Collision?

Vehicle collisions, no matter who is at fault, often cause not only property damage, but also devastating personal injuries as well as liability issues. Side impact collisions, also commonly called T-bone crashes, are those in which a vehicle crashes broadside into another vehicle often causing even more serious injuries than other accidents.

Establishing fault in a side-impact accident is difficult, as these collisions can come as a result of speeding, distracted driving, running a red light or stop sign, or driving under the influence. The driver at fault is liable to the other driver as well as any passengers for injuries and damages.

Who is at Fault?

Side impact collision often result in more severe injuries because the broadside impact area features only a door/window for protection. Side impact crashes have increased by 20 percent in recent decades and are often the result of negligence from the violation of existing traffic laws or driving without proper care.

Road conditions, vehicle problems, along with signs and traffic signals can also contribute to side impact collisions. These accidents are often the result of:

  • Speeding or driving too fast in certain conditions (rain, fog, snow, etc.)
  • Distracted driving
  • Texting while driving
  • Aggressive driving
  • Illegal passing
  • Drunk or otherwise impaired driving
  • Failure to yield the right of way
  • Running a red light or stop sign
  • Cross traffic left turns

In these instances, the driver who failed to follow traffic laws will be deemed at fault, though there are instances when both drivers were negligent, and both will be at fault in the collision.

Injuries Common in Side Impact Collisions

If you are involved in side impact collision, the first priority is to get medical help for anyone injured. Modern safety features – side curtain airbags, seatbelts, torso airbags – can help reduce the risk of severe injuries and fatalities, as can heavier vehicles and those with good side impact ratings.

The problem is the angle of the impact and the speed at impact in a broadside collision can cause acute injuries such as head injuries like concussions or traumatic brain injuries. Other injuries common in side impact collisions include:
