Uber & Lyft Insurance Policies in South Florida

Unknown to many, there are legally mandated insurance policies in place that provide benefits to Uber and Lyft drivers and their passengers when they are involved in an accident that occurs when the rideshare service is being provided. These insurance policies also provide coverage to third parties who may have been involved in an accident involving an Uber or Lyft driver.

The insurance policies that Uber and Lyft have put in place provide different levels of insurance coverage, depending on how the driver was engaged with their rideshare app at the time of the accident. These coverages are as follows:

  1. When the rideshare driver is not online and engaged on the rideshare app. In these cases, there no coverage provided by the rideshare company. The only insurance that will be available to you is the driver’s own personal auto insurance policy and/or your own insurance coverage.
  2. When the driver is online and engaged in the app, but does not have a passenger. Here the rideshare company covers the driver with $25,000 in property damage coverage and $50,000 in bodily injury coverage per person, up to a maximum of $100,000 per accident. But, this will only kick in if and when the driver’s insurance is insufficient to cover your claim.
  3. When the rideshare driver is transporting a passenger or en route to pick up a passenger for transport. If the accident occurs while the driver is on the way to pick up a passenger accepted through the rideshare app or when he or she is carrying that passenger, there is $1 million of liability insurance in place and another $1 million in uninsured/underinsured motorist coverage.

What is the Rideshare Accident Policy for Drivers without Passengers in the Car?

What is the Rideshare Accident Policy for Drivers without Passengers in the Car?

Rideshare drivers are required to carry their own personal liability insurance. In addition, as long as the rideshare driver was online and engaged in the rideshare app, meaning that they were either 1) online waiting for a request, 2) en route to pick up a passenger, or 3) transporting a passenger booked from the app, he or she will be covered under the rideshare company’s liability insurance policy. If not, then you will have to rely on the rideshare driver’s personal auto insurance policy.

This is important to know because, often, a driver who is responsible for causing an accident has the very minimum amount of liability insurance required by law. This means that no matter how serious your injuries and losses are, there will be little or no money to be recovered in a lawsuit. However, when an accident involves an Uber or Lyft driver, for example, an injured person can potentially recover up to a million dollars or more.

If you are injured in a rideshare accident, the most important thing you can do is to get yourself the proper medical care. Even if you feel fine right after the accident, it is a good idea to get yourself checked out. You may have injuries that you are just unaware of. Both Uber and Lyft vehicles are covered by a $1 million insurance policy, but each company handles the claims process differently. What's more, there are a variety of factors that will determine how much coverage is available to you. So, be sure to note the date and the time of the incident and file a formal report with the rideshare company or its insurance provider. Here's everything you need to know about getting injured in an Uber or Lyft Rideshare accident.
The statute of limitations to bring a Florida car accident claim is generally 4 years from the date of the accident for injury claims and 2 years for any wrongful death claims arising from the accident. There are also various nuances related to accidents involving minors and/or municipal vehicles. In any case, if you fail to file a car accident claim before the applicable statute of limitations expires, you may be barred from ever recovering compensation for your injuries and losses. So, don't delay.
If you have been involved in a car accident, it is likely that you’ve received medical help. You should still visit a car accident chiropractor even if you feel fine because some pain and injuries may not present any symptoms for weeks and sometimes even months after the accident such as whiplash.
The answer is yes. You should visit a chiropractor even after a minor accident. It only takes going 5 mph an hour for whiplash to occur. It is best to be examined by a car accident chiropractor to eliminate future complications.
The answer depends on how severe your injuries are. Some people feel relief after the first appointment and others take months to recover. After the first appointment it is normal to feel some soreness which should go away within a few days. This discomfort is caused by your spine coming back into proper alignment.
